1. About Wayplora

Wayplora is a route-planning and navigation tool for outdoor activities including walking, running, and cycling. The App generates circular routes based on your location and preferences.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you confirm you are 13 years of age or older. If you are under 18, you should review these Terms with a parent or guardian.

3. Safety and Outdoor Activity

3.1 Use at your own risk. Outdoor activities carry inherent risks including physical injury, adverse weather, difficult terrain, and getting lost. You accept full responsibility for your own safety when using routes generated by the App.

3.2 Routes are suggestions only. Routes are computer-generated suggestions based on map data and are not a substitute for proper planning, local knowledge, or professional guidance. Always assess a route in person before committing to it.

3.3 Check conditions before you go. Always check weather conditions, your physical fitness, and route suitability before setting out. Carry appropriate equipment, clothing, and emergency supplies. Tell someone where you are going and when you expect to return.

3.4 Not for emergency use. The App must not be used as a primary navigation tool in emergency situations. Always carry a physical map and compass as backup. In an emergency, call 000 (Australia) or the relevant emergency number for your country.

4. Route Accuracy and Land Access

4.1 Accuracy not guaranteed. Route data is sourced from third-party mapping services. We cannot guarantee the accuracy, completeness, or currency of any route. Paths may be impassable, flooded, closed, or dangerous at any time.

4.2 Private land and rights of way. Routes may pass through or near privately owned or restricted land. Access rights vary by location and season. It is your responsibility to verify that any route you follow complies with local access rights and bylaws. You must not trespass on private land. Wayplora accepts no liability for consequences arising from trespass or unauthorised access.

4.3 Dangerous areas. Some routes may pass near hazards such as cliffs, water bodies, roads, or unstable ground. Always assess safety in person. Do not follow a route you believe to be dangerous.

5. User Accounts

5.1 You may use the App without an account. Creating an account allows you to save routes and access personalised features.

5.2 You are responsible for the security of your account credentials. Notify us immediately if you believe your account has been compromised.

5.3 You must not create an account on behalf of another person without their consent, or use the App for any unlawful purpose.

6. Acceptable Use

You agree not to:

• Use the App in violation of any applicable law or regulation
• Attempt to reverse-engineer, hack, or interfere with the App or its servers
• Use the App to generate or distribute harmful, illegal, or offensive content
• Misrepresent your identity or affiliation

7. Third-Party Data and Attribution

The App uses third-party services, including:

• OpenRouteService (openrouteservice.org by HeiGIT) for route generation, using map data © OpenStreetMap contributors (openstreetmap.org).
• Mapbox for map display and navigation (mapbox.com).

Use of these services is subject to their respective terms. We are not responsible for the accuracy or availability of third-party data.

8. Intellectual Property

All content, design, and code in the App is owned by or licensed to us and our licensors. You may not reproduce, copy, or distribute any part of the App without our prior written permission.

9. Limitation of Liability

9.1 Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other applicable law.

9.2 Subject to clause 9.1, we are not liable for: any injury, loss, or damage arising from your use of or reliance on routes generated by the App; loss of data, loss of revenue, or indirect or consequential loss; or disruption, unavailability, or errors in the App or third-party services.

9.3 The App is provided "as is" and "as available" without any warranty of fitness for a particular purpose.

10. Privacy

Our Privacy Policy explains how we collect and use your personal data. By using the App, you agree to our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia.
